1. About us

These Terms of Service (“Terms”) govern your use of https://sabreandsaddle.com (the “Site”) and any purchase made through the Site.

The Site is operated by The Sabre & Saddle Cigar Co. Ltd. (“we”, “us”, “our”).

2. Eligibility and age restriction

Our products are age-restricted. By accessing the Site and/or placing an order, you confirm that:

·       you are 18 years of age or over (or the legal minimum age to purchase tobacco products in your jurisdiction, if higher), and

·       you will not purchase on behalf of, or supply to, anyone under the legal minimum age.

We operate a Challenge 25 approach. We may require age verification at checkout and/or on delivery. If age cannot be verified, we may cancel the order and/or the carrier may refuse delivery.

3. Geographic availability

Unless stated otherwise, we sell and ship within the United Kingdom only.

4. Product information

We take reasonable care to ensure product descriptions, imagery, and pricing are accurate. However:

·       product appearance (including packaging) may vary slightly from images shown;

·       tasting notes and pairing suggestions are subjective and provided for informational purposes only.

5. Orders and contract formation

·       Placing an order constitutes an offer to purchase.

·       An order is accepted when we send an order confirmation and/or dispatch confirmation (depending on the product and purchase type).

·       We may refuse or cancel an order at our discretion, including where we suspect fraud, misuse, or breach of these Terms.

6. Pre-orders and Founder’s Allocation deposits

Some products may be offered on a pre-order basis, including a Founder’s Allocation deposit option.

6.1 Paid-in-full pre-orders

Where a product is sold as a paid-in-full pre-order, you pay the full price at checkout. Dispatch will occur when stock is available.

6.2 Founder’s Allocation (deposit)

Where a product is sold as a deposit:

·       the listing will state that it is a deposit and will specify the total price, the deposit amount, and the balance due;

·       paying the deposit reserves an allocation for you, subject to these Terms;

·       we will request payment of the balance when dispatch is confirmed.

6.3 Dispatch targets and updates

Any dispatch dates are targets/estimates, not guarantees. Once the production order is placed, we aim to provide updates at least weekly.

6.4 Refund backstop (deposit)

Where stated on the relevant product page, if we cannot dispatch by the stated backstop date, you may request a full refund of your deposit.

7. Pricing, taxes, and payment

·       Prices are shown in GBP and include VAT where applicable.

·       Delivery charges (if any) are shown at checkout.

·       Payment is processed via third-party payment providers. We do not store full payment card details.

8. Delivery

·       Delivery timeframes are estimates.

·       Risk of loss passes to you upon delivery.

·       If delivery fails due to inability to verify age, incorrect address details, or failure to accept delivery, we may charge for re-delivery and/or treat the order as cancelled in accordance with our refund policy.

9. Returns and refunds

Our returns and refunds are governed by our Refund Policy, which forms part of these Terms. Where there is a conflict between these Terms and the Refund Policy, the Refund Policy will apply.

10. Prohibited use

You agree not to:

·       use the Site for unlawful purposes;

·       attempt to circumvent age verification;

·       interfere with the Site’s security or operation;

·       reproduce, duplicate, copy, sell, or exploit any portion of the Site except as expressly permitted.

11. Intellectual property

All content on the Site (including text, images, branding, logos, and product names) is owned by or licensed to us and is protected by intellectual property laws. You may not use our intellectual property without prior written permission.

12. Limitation of liability

Nothing in these Terms limits liability where it would be unlawful to do so.

Subject to that:

·       the Site and products are provided on an “as is” basis to the extent permitted by law;

·       we are not liable for indirect or consequential losses;

·       our total liability in connection with an order will not exceed the amount you paid for that order.

13. Privacy

Our handling of personal data is described in our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. The version in force at the time you place an order will apply to that order.

15. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer protections apply.
